SNCBs are not exportable under EU law. This paper asks whether SNCBs discriminate against disabled people exercising their right to free movement. Two further questions will be explored in this article: Firstly, whether the difference of treatment identified falls within the scope of EU law (including under the obligations deriving from the UN Convention on the Rights of Persons with Disabilities), and secondly, whether any discrimination could be justified. | Título: | As alterações recentes ao Código de Fronteiras Schengen : que consequências para os beneficiários da livre circulação? | | Autor(es): | Mariana Pereira | | Resumo: | O presente artigo aborda as alterações recentemente introduzidas ao Código de Fronteiras Schengen, bem como as que se prevêem poder vir a ocorrer num futuro próximo, analisando-se igualmente as suas consequências práticas, em sede de implementação. As normas relativas ao espaço Schengen, codificadas em 2006, assentavam essencialmente em duas premissas: aquando da passagem das fronteiras externas, o controlo levado a cabo seria distinto, consoante estivéssemos perante um beneficiário da livre circulação ou um nacional de Estado terceiro; a regra geral seria a da ausência de controlos nas fronteiras internas, sendo apenas possível realizá-los em casos excecionais, como último recurso.
