Título: The principle of legality in international human rights institutions : selected legal opinions
Autor(es): edited by B. G. Ramcharan
Publicação: The Hague : Martinus Nijhoff Publishers, 1997
Descrição física: XVIII, 393 p. ; 24 cm
Colecção: (The Raoul Wallenberg Institute Human Rights Library ; 3)
Resumo: This book provides dramatic evidence of the principle of legality at work in international human rights institutions during the past half-century. It brings together scattered legal opinions from the early years of the United Nations and renders a great service in chronicling the practice of international law in a vital domain. It is itself a labour of love, having been assembled piece-by-piece over several years. Legal advisers in international organizations and those interested in the craftsmanship of international human rights law will find it indispensable. Those whose vision is to see international human rights law triumph over partisan politicking in international organizations will find a wealth of examples of patient advocacy of the principles of legality and due process. Some of the legal opinions reproduced are stunning for their courage and cogency. No international human rights lawyer should be without this book

Resumo: The Oxford International Encyclopedia of Legal History, edited by Stanley N. Katz, is the first encyclopedia of law to provide both historical and contemporary comparisons of the world legal systems. A truly international and interdisciplinary reference work, the Oxford International Encyclopedia of Legal History covers legal history from ancient to modern times. Approximately 1,000 articles explore the traditions of Ancient Greek Law, Ancient Roman Law, Medieval Roman Law, Chinese Law, English Common Law, Islamic Law, United States Law, and the laws of such other regions as Africa, Latin America, and South Asia. Major categories of law explained in detail include private law (contract, tort, civil procedure), public law (statutory, criminal, etc.), and higher or constitutional law. Using statutes and administrative rulings, judicial decisions, and descriptions of legislatures, agencies, and courts, the Oxford International Encyclopedia of Legal History offers a clear background on geographically distinctive laws, their origins, and their consequences throughout world history

Título: The Oxford handbook of the history of international law
Autor(es): edited by Bardo Fassbender and Anne Peters
Publicação: Oxford : Oxford University Press, 2014
Descrição física: XL, 1228 p. ; 25 cm
Colecção: (Oxford handbooks in law)
Resumo: Covering international legal developments from the 15th century until the end of World War II, the Handbook consists of over sixty individual chapters which are arranged in six parts. The book opens with an analysis of the principal actors in the history of international law, namely states, peoples and nations, international organisations and courts, and civil society actors. Part Two is devoted to a number of key themes of the history of international law, such as peace and war, the sovereignty of states, hegemony, religion, and the protection of the individual person. Part Three addresses the history of international law in the different regions of the world (Africa and Arabia, Asia, the Americas and the Caribbean, Europe), as well as 'encounters' between non-European legal cultures (like those of China, Japan, and India) and Europe which had a lasting impact on the body of international law. Part Four examines certain forms of 'interaction or imposition' in international law, such as diplomacy (as an example of interaction) or colonization and domination (as an example of imposition of law). The classical juxtaposition of the civilized and the uncivilized is also critically studied. Part Five is concerned with problems of the method and theory of history writing in international law, for instance the periodisation of international law, or Eurocentrism in the traditional historiography of international law. The Handbook concludes with a Part Six, entitled "People in Portrait", which explores the life and work of twenty prominent scholars and thinkers of international law, ranging from Muhammad al-Shaybani to Sir Hersch Lauterpacht
