Título: Undertakings caught in the crossfire : US sanctions on Iran vs. the EU Blocking Regulation and possible compensation as State aid

Resumo: This articles sets out the regimes applicable in the United States and the European Union in relation to trade with Iran, as a result of the USA’s withdrawal from the Iran nuclear deal and the EU’s response. These regimes create conflicting obligations on non-US undertakings. On this basis, it is possible to envisage that EU Member States would adopt measures to compensate undertakings for damages suffered as a result of continuing to trade with Iran. This article analyses whether this would fall foul of EU State aid rules and provides guidance regarding the design of any such schemes to prevent their prohibition thereunder

Título: The training of national judges on EU competition law

Resumo: This article presents the main findings of a study recently published by the European Commission on the training needs of national judges in the field of EU competition law. The study, prepared by ERA, the European Judicial Training Network and Ecorys, proposes distinct training profiles, depending on whether judges deal with the public or private enforcement of competition law (or with State aid), the extent to which they are specialised in the field, and other factors that mean that the needs and numbers of judges dealing with EU competition law vary considerably from one Member State to another

Título: State aid for professional football clubs and sports infrastructure

Resumo: On 4 July 2016, the European Commission concluded its investigation into alleged State aid given to several Dutch and Spanish professional football clubs. The central question that the Commission had to decide in each case was whether the behaviour of the Dutch and Spanish authorities had been in line with the so-called ‘Market Economy Operator’ test. With the exception of two Dutch football clubs, the Commission found that all clubs under investigation had been the recipient of State aid, which in respect of the Spanish clubs was not compatible with the internal market

Título: State aid assessments in the aviation and ports sectors : the role for economic and financial analysis

Resumo: State aid issues in the aviation and port sectors are growing, with an increasing number of high-profile cases. The introduction of the 2014 Aviation Guidelines has led to greater potential for sophisticated economic and financial analysis in state aid assessments. As this trend is mirrored in the ports sector, the evidence required to demonstrate compliance with the market economy operator principle or the compatibility of aid is now much greater. Given this backdrop, this article discusses a number of topical issues in state aid assessments in these sectors, illustrated by reference to key decisions from the European Commission

Título: State aid and systemic crises : appropriateness of the european state aid regime in managing and preventing systemic crises

Resumo: The purpose of this paper is to debate the material validity of State aid as a legally and economically rational mechanism to address systemic market crises. In the European Union, Member States shall only participate in the economy when they do so with the same rationality as that of a market investor. Apart from this, State intervention must be restricted to those situations where markets fail and it is necessary to artificially allocate goods and services. However, the 2007/8 financial crisis posed a new challenge for the legal perception of State aid: financial markets failed systemically, and Member States had to intervene to prevent the collapse of the current economic model

Título: Infrastructure and State aid in light of the IPCEI Communication

Resumo: This article discusses infrastructure and State aid in light of the Communication on the compatibility of State aid for the execution of important projects of common European interest (the IPCEI Communication), which has been adopted by the European Commission (Commission), with a view to have a standard approach to State aid cases involving large infrastructure projects. (Official Journal C 188 of 20.6.2014, p. 4; see also EC Press Release of 13 June 2014, available at: While the provisions set out in the Communication do indeed bring about guidance, so far only two decisions have been adopted in light of the Communication and they do not seem to be consistent- neither with each other, nor with the preceding decision-making practise of the Commission on infrastructure. Furthermore, given that the IPCEI Communication addresses the compatibility of State aid, it will only be applicable in cases where infrastructure projects involve an economic activity in the first place. This is, however, a contentious issue which has not only been the subject of several court cases, but also has been addressed in the Commission’s recent Communication on the Notion of Aid. It is all the more important given that the Commission President Juncker’s European Fund for Strategic Investments allocates a good share of the funding to infrastructure projects which may, however, risk being caught up in lengthy State aid approval procedures, and suffer delays as a result
