330   ^aFreedom of expression, taken in a broad sense, is an essential dimension of the Constitutional State ideal type. Democracy, the rule of law and separation of powers, including social and economic powers, depend on the free development of public opinion and political will, through the legal protection of communication rights and freedoms. However, it is not enough to protect the media from all kinds of political and administrative interference, including censorship and prior restraints. The political and legislative power is often very creative in devising legal ways of restraining and inhibiting free and open debateon matters of public interest, from a political, economic and social perspective. Against this background, it is important to devote attention to the critical analysis of the systems of civil and criminal liability related to the supposed violation of the rights to honor, good name and reputation of public figures, including collective and corporate entities that play a relevant role in the political, economic, social and cultural systems. Far from being innocuous, from the standpoint of freedom of expression and democratic self-government, the systems can be used in a restrictivemanner, againstthe democracy and the rule of law.
